Henna Services – Terms & Conditions

1. Definitions
1.1 “ByKarisma”, “we”, “us” or “our” refers to HennabyKarisma trading as ByKarisma.
1.2 “Client” refers to any individual booking or enquiring about henna or jagua services.
1.3 “Services” refers to all henna and jagua services provided by ByKarisma.
2. Bookings & Acceptance
2.1 All bookings made via website, email, social media or messaging platforms are subject to these Terms & Conditions.
2.2 A booking is confirmed once a deposit has been received and acknowledged.
2.3 By proceeding with a booking, the client confirms they have read and agreed to these Terms & Conditions.
3. Deposits & Payments
3.1 A £100 non-refundable deposit is required to secure bridal bookings.
3.2 A fixed deposit is required for private and party bookings.
3.3 Deposits are non-refundable unless ByKarisma is unable to attend the booking.
3.4 Full payment must be completed prior to the application date, unless otherwise agreed in writing.
4. Cancellations & No-Shows
4.1 Deposits are non-refundable in the event of cancellation by the client.
4.2 Same-day ancellations or failure to attend will result in the full balance remaining payable.
5. Allergies, Patch Tests & Skin Responsibility
5.1 ByKarisma uses natural henna and jagua products believed to be safe and suitable for skin application.
5.2 Ingredient information is available on our website.
5.3 It is the client’s responsibility to disclose any allergies, sensitivities, skin conditions or medications prior to booking.
5.4 Patch tests are available upon request and must be requested in advance.
5.5 ByKarisma accepts no liability for adverse reactions where a patch test was declined or not requested.
6. Aftercare & Stain Results
6.1 Henna stain results vary due to skin type, body temperature, placement and aftercare.
6.2 ByKarisma is not responsible for poor stain results caused by improper aftercare.
6.3 Full aftercare instructions are provided and available at www.bykarisma.co.uk.
7. Working Conditions & Set up
7.1 The Client must provide a chair, arm-level table and a well-lit working area.
7.2 Mood lighting, dim lighting or coloured lighting is not acceptable as it impacts the quality, accuracy and speed of the service. If adequate lighting is not provided, ByKarisma reserves the right to pause or refuse the service without refund.
7.3 ByKarisma must be allowed reasonable breaks for food, water, bathroom use and prayer, including access to a suitable prayer space when required.
8. Property & Surface Disclaimer
8.1 Natural henna and jagua products may stain porous surfaces, fabrics or furniture if accidental contact occurs.
8.2 ByKarisma accepts no responsibility for staining to property, clothing or personal items.
9. Photography & Content Usage
9.1 By booking with ByKarisma, the Client agrees that photographs and/or videos of the henna work may be taken and used for portfolio, website and social media purposes.
9.2 Clients will not be identified or tagged unless permission is given.
10. Governing Law
These Terms & Conditions are governed by English law.
11. Digital Products (Artists, Aftercare Guides & Downloads)
11.1 Digital products include but are not limited to:
Henna or jagua aftercare guides
Artist resources, templates, guides or educational materials
Any downloadable or online digital content sold by ByKarisma
11.2 All digital products are non-refundable and non-exchangeable once purchased, due to the nature of digital content.
11.3 Digital products are provided for personal or professional use only.
They must not be:
Shared
Resold
Reproduced
Distributed
Uploaded or repackaged in any form
11.4 Ownership of all digital products remains with HennabyKarisma trading as ByKarisma.
Purchase grants a non-transferable, non-exclusive licence to use the product.
11.5 ByKarisma is not responsible for how digital products are used, applied or interpreted once accessed.
11.6 While care is taken to ensure accuracy and quality, digital products are provided for educational and informational purposes only and do not guarantee specific results.
12. Physical Products (Tealight Candles & Other Products)
12.1 Physical products include but are not limited to:
Hand-painted tealight candles
Decorative or lifestyle products
Any future physical items sold by ByKarisma
12.2 Due to the handmade nature of products, slight variations in colour, design or finish may occur. These are not considered faults.
12.3 All physical product sales are final, except where an item arrives damaged or faulty.
12.4 ByKarisma must be notified of any damaged or faulty items within 48 hours of delivery, with clear photographic evidence provided.
12.5 Products must not be used in a way that differs from their intended purpose.
ByKarisma accepts no liability for misuse, improper handling or failure to follow care instructions.
12.6 Candles must be used responsibly and in accordance with standard candle safety guidelines.
ByKarisma is not responsible for damage, injury or loss caused by incorrect or unsafe use.
13. Shipping & Delivery (Reference Section)
13.1 Shipping methods, delivery timelines, processing times and costs are outlined separately on the Shipping & FAQs page.
13.2 ByKarisma is not responsible for delays caused by postal services once an order has been dispatched.
14. Governing Law
These Terms & Conditions are governed by and interpreted in accordance with English law.
